Extreme DUI  
While most DUIs are “simple” and result from a traffic stop or a minor accident, there are also DUIs that are considered “extreme.”  That term has a definitive legal meaning in Arizona; an “extreme DUI” is a DUI charge based on a blood alcohol content between .150 and .200 percent.  Under the Arizona Revised Statutes, Section 28-1382, extreme DUI can incur harsher penalties than a standard DUI. A conviction may include penalties such as driver's license suspension, fines of about $2,700, minimum jail time of 30 days and more.
 

Aggravated DUI
An aggravated DUI is a class 4 felony.  This type of crime is charged with a person is driving with any amount of alcohol in his or her system and also commits one of the following: 

  • Is driving on a suspended, restricted, cancelled or revoked drivers’ license or has never had a valid license
  • Has two DUI convictions within seven years of the current charge 
  • Has been ordered to have but was not using an ignition interlock device

Mr. Weinstein came to the Oswalt Law Group, P.C. after working for a time in the Public Defender’s Office. During his time at the Public Defender’s Office, Mr. Weinstein represented clients in all types of criminal cases, including homicide, sex crimes, white collar crimes, DUI’s, burglaries, drug sales and drug possession, dangerous felonies, and misdemeanors. Since joining the Oswalt Law Group, P.C. Mr. Weinstein has concentrated his skills on criminal defense matters and continues to assist clients in all types of criminal cases with a heavy concentration on DUI cases. Mr. Weinstein prides himself on aggressively and competently representing the firm’s clients.

Mr. Weinstein received his Bachelor of Arts from Arizona State University’s Walter Cronkite School of Broadcast Journalism and Telecommunications and later attended the Thomas M. Cooley Law School and and graduated in 2008 with his Juris Doctorate.
